FreeBSD has that in a separate "contrib" folder. I think they somewhere tell you that it has separate licenses. Additionally, FreeBSD distributes the device tree as separate files.

Your solution links it into a blob in the binary. You can find both opinions: Some people will tell you that a blob doesn't "infect" the remaining system with GPL. Other people will tell you that it will. Licenses are a legal topic and it's really hard to estimate how a court would decide. Especially because RTEMS is a worldwide project and therefore you have to guess it in multiple legal systems. Therefore, it's usually something where an open source project just has to be careful.
