freebsd nge driver

Hi,

I am interested in possibly using FreeBSD's gigabit ethernet driver
located in the FreeBSD repository at src/sys/dev/nge/if_nge.c -- but I
found an advertising clause, which as I understand would preclude
packaging it as part of RTEMS.

Could anyone tell me if this is still in effect?  The code header
reads like this:
