I added <sys/tree.h> some months ago to Newlib:

2015-03-23  Sebastian Huber <sebastian.huber at embedded-brains.de>

     * libc/include/sys/tree.h: New file.

The or1k should use the upstream Newlib. If this is not possible, then 
we should add some Autoconf stuff to provide a <sys/tree.h> if necessary 
(similar to <semaphore.h>).
